PFAS Class-Action Lawsuit Provides Over $11 Billion For Affected Public Water Systems

PFAS, per- and polyfluoroalkyl substances, are a category of manufactured chemicals that have been used in industry and consumer products. PFAS are known as “forever chemicals” because they are nearly indestructible; their persistence in the environment and prevalence across the country make them a unique water-quality concern. The United States Environmental Protection Agency is proposing a National Primary Drinking Water Regulation to establish legally enforceable maximum contaminant levels that will require the installation of additional treatment technologies for many public water systems nationwide.

Various lawsuits have been filed against chemical makers for covering up the dangers of PFAS. Recently, federal courts granted final approval for settlements involving 3M and DuPont, who manufactured PFAS. This action has provided an opportunity for affected public water systems to claim settlement payments.

At this time, only public water systems can file a claim, either directly or with the assistance of an attorney. The Phase One claim window is short; however, the Phase Two deadline extends until 1/1/2026.
