NJDEP Announces Delay of Full REAL Rule Implementation

The New Jersey Department of Environmental Protection (NJDEP) has officially announced a delay in the implementation of the full Resilient Environments and Landscapes (REAL) rules.

The delay is expected to extend at least one year and will allow time to reconsider elements of the adopted rule through a formal stakeholder engagement process. NJDEP also indicated that future rulemaking may be pursued to revise or moderate aspects of the current framework.

The REAL rules, adopted in January 2026, represent a sweeping update to New Jersey’s land use and environmental regulations, including significant changes to coastal zone management, flood hazard standards, and stormwater requirements. This announcement reflects a shift toward additional collaboration with industry, municipalities, and other stakeholders as the State evaluates implementation challenges and potential refinements.
